Telangana: Supreme Court’s Sensational Comments on Defections!

NEWS CHARIOT:-The Supreme Court is currently hearing petitions related to the defection of MLAs in Telangana. A bench comprising Justice B.R. Gavai and Justice Augustine George Masih are presiding over the case. The court made critical remarks on political defections, stating that the 10th Schedule of the Constitution exists to prevent party switching, and failing to take action would mock the law.

The BRS party filed a complaint with the Telangana Assembly Speaker on March 18, 2024, about MLAs defecting to Congress.Despite this, no notices were issued, even after approaching the High Court.The High Court Division Bench ordered action within a reasonable time, but no steps were taken.The defected MLAs actively campaigned for Congress in the Lok Sabha elections.The Speaker claimed notices were issued, but copies were not provided.The Supreme Court should set a specific deadline for the Speaker to decide on defections.

The bench strongly criticized the delay and warned against stalling tactics.“How much time is required to issue notices?” the court asked.The court emphasized that judicial review applies to the Speaker’s actions.

The Assembly Secretary, on behalf of the Speaker, argued that the judiciary cannot direct the Speaker and that each case requires different timelines.The Speaker must decide first before courts intervene.Two MLAs filed affidavits claiming they never defected from BRS and requested dismissal of petitions.

The BRS party filed petitions against 10 defected MLAs in the Supreme Court in January. Despite Telangana High Court’s earlier ruling, the Speaker has yet to act. The Supreme Court remains firm on ensuring justice, stating: “The operation was successful, but the patient died”, indicating that justice delayed is justice denied.
